World of Milano wishes to inform you that the provision of certain mandatory personal data is a necessary condition for providing our services. If the aforementioned personal information is not provided, World of Milano will not be able to offer you its services.

8. YOUR RIGHTS AS A DATA SUBJECT

            8.1. Guarantee of compliance with principles specific to the processing of personal data

World of Milano only processes your personal data:

  • In a proper, lawful and transparent manner where the processing, as the case may be, is supported by the following legal grounds:

    • Consent: personal data are processed following your consent.

    • Legitimate interest: the personal data can be processed if it is in the legitimate interest of World of Milano as a company, insofar as your personal interests do not outweigh it.

    • Agreement: the processing of personal data is necessary for the performance of the agreement with World of Milano.

    • Legal obligation: the processing of personal data must be done so that World of Milano can fulfill its legal obligations.

  • In a manner proportional to the stated purpose;

  • In a proper way;

  • Basically during a period equal to five (5) years after the last activities on the website or five (5) years after the execution of the agreement;

  • In cases determined by law, during period equal to the statutory retention period;

  • In a manner that includes adequate safeguards against unauthorized access, unlawful processing and/or accidental loss or damage.

            8.2. Right of access

Any Customer or Visitor who satisfactorily proves their identity shall have the right to obtain from World of Milano confirmation as to whether or not personal data concerning them are being processed and, if so, to obtain access to the personal data.

In doing so, you have the right to obtain information about the purposes of processing, the categories of personal data being processed, the recipients of the personal data, the (criteria to determine the) period (to be) during which your personal data will be stored and the rights you can exercise in accordance with the AVG.

If you wish to exercise your right of access / rectification / deletion, World of Milano will do so within one (1) month after receiving the request and only if this right exists on your behalf. The request is made via registered mail or via email to: info@worldofmilano.be.

Personal data that is incomplete or inaccurate may be corrected or erased at any time. You may exercise your right of rectification by providing World of Milano with a supplemental statement. World of Milano will act on this within one (1) month after receiving the additional statement.

In addition, you have the right to have your personal data erased by World of Milano without unreasonable delay. You can only exercise this right in the following cases, which World of Milano will assess:

  • When your personal data are no longer needed for the purposes for which they were collected or processed;

  • When you withdraw your consent and no other legal basis exists for the processing;

  • When objection is made to the processing and no overriding compelling legitimate grounds for the processing exist;

  • When personal data has been processed unlawfully;

  • When your data must be deleted in accordance with a legal obligation.

            8.3. Right to restriction of processing / right to object.

You have the right to obtain from World of Milano a restriction on processing if any of the following applies:

  • You dispute the accuracy of the personal data;

  • World of Milano's processing appears to be unlawful and you do not wish to erase the personal data, but you do wish to have the processing restricted;

  • World of Milano no longer needs your personal data for processing purposes, but you still need it for the establishment, exercise or substantiation of legal claims;

  • World of Milano must assess the presence of the grounds for erasure of personal data and during this period. 

You also have the right to object at any time to the processing of your personal data for reasons relating to your particular situation. World of Milano will then cease processing your personal data, unless World of Milano can provide compelling legitimate grounds for processing your personal data that outweigh your right to object.

In addition, you have the right not to be subjected to individualized and fully automated decision-making where this has legal consequences or where such a decision could significantly affect you. However, you can always intervene in such decision-making yourself or request human intervention.

Finally, you have the right to object to the processing of personal data for direct marketing at any time.

            8.4. Right to data portability.

You have the right to obtain the personal data provided to World of Milano in a structured, common and machine-readable form. In addition, you have the right to transfer this personal data to another controller when the processing of your personal data is based solely on your consent.

            8.5. Right to oblivion

Whenever you have rightly requested World of Milano to rectify, erase or further limit the processing of your personal data, World of Milano will notify each recipient of such personal data, unless this proves impossible or would involve an unreasonable effort. You may also receive information about these recipients at any time.

            8.6. Right to withdraw your consent / right to complain

You always have the right to withdraw your consent. The withdrawal of consent does not affect the lawfulness of the processing based on the consent before its withdrawal. In addition, you have the right to lodge a complaint regarding the processing of your personal data by World of Milano with the competent supervisory authorities.

            8.7. Right to information and transparency

When exercising your rights, World of Milano will always act in accordance with the AVG and thus provide all information required by the AVG in a concise, transparent, understandable and easily accessible form which you will receive in a plain language.

The deadlines for responding to your requests may be extended in exceptional circumstances, including the complexity/multitude of your requests. To that end, World of Milano will notify you of such extension and the reason for such extension within one (1) month of receiving your request.

            8.8. Right to file a complaint

World of Milano recognizes that the security of personal data is an essential part of data protection.

Therefore, World of Milano takes appropriate technical and organizational measures to protect your personal data against destruction, loss, alteration, unauthorized processing or unauthorized access in order to prevent misuse.
